The Wright Brothers left Ohio and made the long, and in the final stage quite difficult, journey to Kitty Hawk, North Carolina, in order to conduct their experiments in sufficient secrecy to protect their patent position. Ironically, their excessive concern about secrecy over the next few years, following the successful flight in 1903, probably was the primary reason competitors left them behind.

Magnetic Power Inc. is simultaneously developing solid-state devices we believe have commercial potential, and toys that we intend to make readily available through toy manufacturers, in order to let anyone demonstrate, to their own satisfaction, that new energy systems are real. We expect to license our technology world-wide on generous terms, and anticipate that companies manufacturing generators will decide when and how to introduce them to the public. Initial toys will probably enter the market in roughly the same time frame, and are presently expected to have a rotating armature, and light at least a couple of small lamps. Designed so that no hidden battery can be concealed, a booklet will be included, illustrating and discussing the science and technology.

Patent law in some countries, e.g. Taiwan and South Korea, precludes issuance of a patent in those nations if an invention is revealed prior to the filing of a patent application. Most other countries, including the U.S., allow filing within one year following any form of public disclosure. The need to balance disclosure and the reasonable protection of intellectual property is never simple. Large companies will roll over small ones that neglect their patent position. They will often try to do so in any case. In recent years, the courts in the U.S. have made some impressive awards that slightly restore the balance. For example, Fonar successfully sued General Electric for infringement of the two fundamental patents covering Magnetic Resonance Imaging (MRI). Fonar was awarded more than $125 million when GE lost the case, a little more than three years ago. Adequate capital for world-wide patent filings and fees is a major concern for small firms. Major breakthroughs in technology may easily require several patents. When excellent law firms are involved, costs in numerous nations can readily add up to more than $100,000 per patent.

But, all of the above notwithstanding, widespread public demonstrations will surely be necessary to demonstrate that new energy technology is genuine, and can make a real contribution to the pressing problems of energy supply.
